These Terms of Service (“Terms”) govern access to and use of The 5Ws Store, operated by 5Ws, LLC, and purchases or use of products, digital materials, and services offered through the store.

Throughout these Terms, “5Ws,” “we,” “us,” and “our” refer to 5Ws, LLC.

By accessing or using The 5Ws Store or placing an order, you agree to these Terms and applicable store policies.

If you do not agree to these Terms, you should not use the store or purchase products through it.

Our online store is hosted by Shopify, which provides the e-commerce platform through which we offer our products and services.

Shopify collects and processes personal information relating to access to and use of The 5Ws Store, including when customers visit or make purchases, to provide, secure, personalize, improve, and support Shopify’s platform and related services. This includes Shopify Enhanced Services powered by Shopify Network Intelligence, which may incorporate information from interactions with The 5Ws Store, other Shopify merchants, and Shopify.

Information submitted through The 5Ws Store will be transmitted to and shared with Shopify and other third parties, which may be located in countries other than where you reside, in order to provide these services, including Shopify Enhanced Services.

For more information, review Shopify’s Consumer Privacy Policy. To exercise choices or rights relating to Shopify’s processing, use Shopify’s Privacy Portal. Where applicable, you may also use The 5Ws Store’s Data Sharing Opt-Out page.

1. Eligibility to Purchase

You must be at least 18 years old or the age of legal majority in your jurisdiction, whichever is greater, and legally capable of entering into a binding agreement to place an order through The 5Ws Store.

This purchasing requirement is separate from the age grading of any particular product.

The Writer’s UnBlock™ plush toy is identified as All Ages, consistent with its final product testing and safety documentation.

A parent, legal guardian, educator, or other responsible adult may purchase products for use by children consistent with applicable product information, labels, instructions, and warnings.

2. Guest Checkout and Customer Information

Guest checkout may be available and is not conditioned on creating a customer account.

You agree to provide current, complete, and accurate information when placing an order, including applicable:

  • billing information;

  • shipping information;

  • payment information; and

  • contact information.

You are responsible for reviewing information submitted with your order before completing the transaction.

If customer-account functionality is offered now or in the future, you are responsible for safeguarding your account credentials and for activity reasonably attributable to your account.

3. Products and Services

The 5Ws Store may offer physical and digital products, including:

  • plush toys;

  • books;

  • educational materials;

  • creative materials;

  • downloadable activities;

  • worksheets;

  • printables;

  • digital resources; and

  • related products.

We may introduce, modify, discontinue, or limit products or services prospectively.

Product availability is not guaranteed until an order has been accepted and fulfilled.

4. Order Acceptance

Submitting an order does not require 5Ws, LLC to accept or fulfill that order.

We reserve the right, where reasonably necessary, to decline, limit, hold, or cancel an order because of legitimate business, security, operational, or legal concerns, including:

  • suspected fraud or unauthorized payment activity;

  • payment authorization problems;

  • pricing, inventory, product-description, or technical errors;

  • product unavailability;

  • suspected unauthorized resale or misuse;

  • unusually large quantities requiring separate arrangements;

  • violation of these Terms or another applicable store policy; or

  • circumstances in which fulfillment would violate applicable law.

If we cancel an order after payment has been collected and the applicable product has not been provided, we will issue an appropriate refund.

We will not exercise our order-acceptance rights in a manner prohibited by applicable law.

5. Order Cancellations

Ordinary Physical Orders

Where available, customers may use Shopify’s self-service functionality to submit cancellation requests for eligible unfulfilled physical items.

Submission of an ordinary cancellation request does not guarantee that an order can be stopped before shipment.

Because 5Ws, LLC personally fulfills physical orders, an order may already be undergoing:

  • picking;

  • packing;

  • labeling;

  • preparation for shipment; or

  • transfer to a shipping carrier

before a cancellation request is received or reviewed.

We will make reasonable efforts to accommodate cancellation requests for ordinary in-stock physical products before fulfillment or shipment.

If we are able to cancel an ordinary physical-product item before shipment, the applicable amount paid for the cancelled merchandise and any shipping charge reasonably attributable to that cancelled unshipped item or shipment will be refunded.

If other shippable items remain in the order, shipping charges attributable to those remaining items or shipments may remain applicable.

If an ordinary physical-product item has already shipped, that item can no longer be cancelled and instead becomes subject to our Return and Refund Policy.

Preorders

Preorders are subject to a separate and broader cancellation right.

A customer may cancel an eligible physical-product preorder for a full refund at any time before that preorder item has shipped.

This right applies regardless of whether Shopify’s self-service cancellation option remains available at the time of the request.

If a self-service option is unavailable but the preorder has not yet shipped, the customer may contact:

For purposes of these Terms, a preorder item is considered shipped when that merchandise has been transferred to the shipping carrier for delivery.

For orders with multiple preorder items or separate physical shipments, cancellation eligibility is determined separately for each applicable preorder item.

Shipment of one item does not automatically eliminate the cancellation right for another eligible preorder item that has not yet shipped.

An eligible preorder cancellation includes refund of amounts paid for the cancelled merchandise, applicable taxes, and any shipping charge reasonably attributable to the cancelled unshipped preorder item or shipment.

If no other shippable items remain, the applicable shipping charge collected for the order will also be refunded.

We do not charge a cancellation fee or restocking fee for a properly cancelled preorder before shipment.

Once a preorder item has shipped, it becomes subject to our ordinary physical-product return provisions.

Digital Products

Digital products may be delivered electronically shortly after successful payment.

A digital-product order may be cancelled before delivery only when electronic access has not yet been provided and cancellation remains reasonably and technically possible.

Once the digital product, download link, or other access to the purchased digital content has been provided, the purchase is generally final and cannot be cancelled, returned, exchanged, or refunded, except where otherwise required by applicable law.

6. Retail and Bulk Orders

The 5Ws Store is primarily intended for retail purchases.

Standard online checkout is currently configured for orders of up to eight (8) units of each individual physical product.

An order exceeding that quantity may require custom packaging, multiple shipments, separate shipping arrangements, or other manual fulfillment review and may not receive an available standard shipping method through ordinary checkout.

Customers wishing to purchase more than eight units of an individual physical product should use our Bulk Orders page or contact:

before ordering so that we can discuss product availability, fulfillment timing, packaging, shipping, and other applicable arrangements.

We may also consider larger-volume, classroom, institutional, organizational, business, wholesale, or other bulk purchases.

Large or bulk orders may require separate confirmation and may involve different:

  • pricing;

  • quantities;

  • minimum order requirements;

  • lead times;

  • payment terms;

  • shipping arrangements;

  • product availability;

  • fulfillment arrangements; or

  • digital licensing terms.

Where 5Ws, LLC and a purchaser enter into a separate written agreement, accepted quotation, purchase-order arrangement, or other expressly agreed terms governing a bulk transaction, those specific terms will control to the extent they directly conflict with these general Terms.

We reserve the right to limit quantities or contact a purchaser before accepting an unusually large order.

The standard online quantity limit may be changed prospectively as our packaging and fulfillment capabilities develop.

Physical products in an ordinary retail order may be shipped in more than one package when reasonably necessary because of product size, quantity, packaging requirements, or the combination of products ordered.

The shipping charge displayed at checkout may reflect the combined shipping charge associated with more than one physical package, as described in our Shipping Policy.

7. Prices, Payments, and Taxes

Prices are displayed in U.S. dollars unless otherwise stated.

Payment is processed through the payment methods made available through Shopify checkout.

Applicable sales taxes and similar charges will be calculated and collected through checkout as required.

Prices may change prospectively without notice.

You agree to provide valid payment information and represent that you are authorized to use the payment method submitted with your order.

8. Pricing, Inventory, and Listing Errors

We make reasonable efforts to provide accurate pricing, product descriptions, inventory information, and other store information.

Errors may nevertheless occur.

Where permitted by applicable law, we may correct:

  • obvious pricing errors;

  • typographical errors;

  • inventory errors;

  • technical errors;

  • inaccurate product information; or

  • other listing errors.

Where legally permissible, an affected order may be cancelled.

If an order is cancelled after payment has been collected and the product has not been provided, the applicable amount will be refunded.

9. Product Descriptions and Natural Variation

We work to describe and depict our products accurately.

Certain physical products, particularly soft and textile products such as plush items, may exhibit normal variation resulting from their materials and manufacturing processes.

Reasonable variations may include minor differences in:

  • shape or fullness;

  • seam placement;

  • stitching;

  • fabric alignment;

  • fabric nap or texture;

  • dimensions within ordinary manufacturing tolerances;

  • embroidery placement or appearance;

  • packaging; or

  • color appearance caused by materials, photography, lighting, or display settings.

Reasonable manufacturing variation does not necessarily constitute a defect.

This provision does not excuse a product that is defective, unsafe, materially damaged, materially different from the product ordered, or otherwise fails to satisfy applicable legal requirements.

10. Photography, Illustrations, and AI-Generated Images

The 5Ws Store may use:

  • photographs;

  • illustrations;

  • digitally created imagery;

  • enhanced or composited imagery;

  • product renderings; and

  • artificial-intelligence-generated imagery

for illustrative, explanatory, advertising, and marketing purposes.

Unless expressly stated otherwise, adults or children appearing in fictional, illustrative, rendered, or AI-generated imagery should not be understood to be actual customers, employees, product testers, purchasers, or endorsers of 5Ws, LLC.

We endeavor to represent relevant product characteristics fairly.

Customers should rely on applicable product descriptions, dimensions, materials, specifications, labels, warnings, and other product information when making purchasing decisions.

11. Product Use and Safety

Customers are responsible for using, handling, and caring for physical products consistently with applicable labels, instructions, warnings, and other product information.

Physical products intended for children will not be offered for sale until applicable testing, certification, labeling, and other product-safety requirements applicable to those products have been addressed.

If you believe a physical product is defective or may present a safety concern, discontinue use when appropriate and contact:

Nothing in these Terms limits any product-safety right, protection, recall obligation, reporting requirement, remedy, or other legal protection that cannot be waived.

12. Educational and Creative Products

Products offered through The 5Ws Store may support:

  • writing;

  • creativity;

  • questioning;

  • learning;

  • education;

  • brainstorming;

  • communication; or

  • idea development.

Individual experiences and results vary.

Unless expressly stated otherwise, we do not guarantee any particular:

  • educational outcome;

  • academic performance;

  • creative result;

  • improvement in writing ability;

  • professional result;

  • classroom outcome; or

  • other subjective outcome.

13. Digital Product License

Unless different product-specific terms are expressly provided, purchase of a digital product grants the purchaser a limited, non-exclusive, non-transferable license for:

  • personal or household use; or

  • use by one educator within one classroom or equivalent instructional group.

Purchase of a digital product does not transfer ownership of the underlying intellectual property.

14. Single-Classroom Use

Under the default single-classroom license, one educator may reproduce or distribute the purchased material as reasonably necessary for use with that educator’s own students.

Students may use, complete, retain, and take home copies properly provided to them as part of that authorized classroom use.

An educator may also provide materials through a password-protected or access-restricted classroom or learning-management platform, provided access is limited to that educator’s applicable students.

A single-classroom license does not authorize:

  • school-wide use;

  • department-wide use;

  • district-wide use;

  • organization-wide use;

  • multi-teacher sharing; or

  • other institutional sharing

unless the applicable product expressly provides otherwise.

Another educator who wishes to use the material independently with their own classroom should obtain a separate applicable license.

15. Permitted Modification of Digital Materials

Customers may print, write on, resize, cut, annotate, or otherwise adapt digital materials as reasonably necessary for their permitted personal, household, or classroom use.

Modification does not transfer ownership of the underlying work and does not create a right to sell, publish, license, sublicense, or redistribute the original or modified material outside the permitted license.

16. Prohibited Uses of Digital Materials

Except where expressly authorized by 5Ws, LLC, applicable product-specific terms, or applicable law, digital products may not be:

  • resold;

  • sublicensed;

  • redistributed outside the permitted license;

  • shared with other educators for independent classroom use;

  • publicly posted online;

  • uploaded to publicly accessible repositories or shared drives;

  • incorporated into products offered for commercial sale;

  • reproduced for commercial distribution;

  • used to create a substantially derivative competing product for commercial sale;

  • uploaded to commercial content libraries or mass datasets for redistribution;

  • used for commercial artificial-intelligence model training, machine-learning dataset development, or similar mass-ingestion purposes; or

  • used in a manner that deliberately removes or obscures proprietary notices.

Nothing in this provision is intended to prohibit ordinary personal use of lawful technology tools in connection with an otherwise permitted use of the material.

Specific terms provided on a product page or within a digital product may grant additional rights or impose additional restrictions.

When product-specific license terms are provided, those terms govern that particular product.

17. Digital Product Sales and Delivery

Digital products are generally final sale once electronic access has been provided, as described in our Return and Refund Policy.

If a legitimate technical problem prevents you from accessing a purchased digital product, contact:

We will make reasonable efforts to provide access, resend an applicable download link, provide a replacement download, or provide a corrected file when appropriate.

A technical access problem does not automatically create a right to a refund when the purchased digital product can otherwise be successfully provided.

18. Preorders

We may offer designated physical products for preorder before inventory is available for ordinary shipment.

A preorder product page or checkout will disclose available information concerning anticipated shipment timing and payment.

All preorders currently offered through The 5Ws Store are one-time purchases.

Payment for a preorder is currently collected once, in full, when the preorder is placed.

Current preorders do not involve subscriptions, installment plans, recurring charges, or later automatic charges.

Any advertised preorder shipment date, month, season, or shipping window will be based on information reasonably available to us when stated.

Preorder timing may be affected by:

  • manufacturing or production;

  • supplier or intermediary delays;

  • freight or transportation;

  • supply-chain conditions;

  • material shortages;

  • port or customs delays involving third parties;

  • tariffs, duties, trade requirements, or governmental policies;

  • fulfillment;

  • carrier delays;

  • labor disruptions;

  • severe weather;

  • natural disasters; or

  • other operational circumstances.

A customer may cancel an eligible preorder item for a full refund at any time before that preorder item has shipped, as described above and in our Purchase Options Cancellation Policy.

For an order containing multiple preorder items or separate shipments, shipment of one item does not automatically eliminate the cancellation right for another eligible preorder item that has not yet shipped.

Estimated preorder shipment timing is an estimate rather than a guarantee. This does not eliminate any rights provided by applicable law.

If we determine that we cannot ship within a timeframe represented to the customer, we will provide any required:

  • notice of delay;

  • revised shipment information;

  • opportunity to consent to the delay;

  • cancellation option; and

  • refund.

Additional product-specific preorder terms disclosed before purchase form part of the applicable transaction.

19. Physical Product Returns

Our physical products are currently subject to a 14-calendar-day voluntary return window beginning on the date of delivery.

For an order delivered in multiple packages or on different dates, the applicable return period for an individual physical product begins on the date that product is delivered.

An eligible physical product may be returned for any reason during that period, provided it satisfies the condition and eligibility requirements stated in our Return and Refund Policy.

Ordinary voluntary returns must be:

  • unused;

  • clean;

  • unwashed;

  • undamaged;

  • free from stains;

  • free from odors;

  • free from alterations or other signs of use; and

  • otherwise in substantially the condition in which the product was received.

Nothing in these Terms creates a return right beyond the rights expressly provided in our Return and Refund Policy or required by applicable law.

20. Return Shipping Costs

Customers are responsible for return shipping costs associated with ordinary voluntary physical-product returns, including returns based on preference or a change of mind.

The applicable return shipping method or cost may depend on the return process, package, destination, product, and carrier available at the time.

We do not guarantee a particular return-shipping fee.

Original shipping charges are generally not refundable solely because an otherwise satisfactory physical product is voluntarily returned, including when only part of a multi-item order is returned.

When an item arrives damaged or defective, we send the incorrect product, or another fulfillment error for which 5Ws, LLC is responsible occurs, appropriate shipping costs will be handled as described in our Return and Refund Policy.

21. Promotions and Discount Codes

We may offer:

  • sales;

  • discount codes;

  • promotional pricing;

  • giveaways;

  • bundles; or

  • other promotional programs

from time to time.

Additional terms may apply to a particular promotion.

Unless expressly stated otherwise:

  • promotions may not be combined;

  • eligibility requirements may apply;

  • discounts have no cash value;

  • promotions may be modified or discontinued prospectively; and

  • fraudulent use, duplication, or exploitation of a technical error may result in correction or cancellation where legally permitted.

Any refund involving a discounted purchase will generally be based on the amount actually paid for the applicable product.

22. Intellectual Property

Original content associated with The 5Ws Store may include:

  • trademarks;

  • branding;

  • logos;

  • product names;

  • original product artwork;

  • website copy;

  • graphics;

  • photographs;

  • illustrations;

  • digital products;

  • printable materials;

  • instructional materials; and

  • other creative works

owned by or licensed to 5Ws, LLC.

5Ws™ and The Writer’s UnBlock™ are trademarks claimed by 5Ws, LLC. Applications seeking federal registration of these marks are currently pending.

Nothing in these Terms claims exclusive ownership of ordinary words, general ideas, educational concepts, or other material that is not legally protectable.

Except for rights expressly granted under an applicable license, no ownership of intellectual property belonging to 5Ws, LLC is transferred to a customer.

23. Linking and Sharing

Customers may ordinarily share links to publicly available pages of The 5Ws Store, including through email and social media.

This permission does not authorize copying, republishing, distributing, framing, impersonating, or presenting substantial proprietary store content as someone else’s work.

24. Copyright and Intellectual Property Concerns

If you believe material appearing through The 5Ws Store infringes copyright, trademark, or another intellectual property right, please contact:

Please provide sufficient information for us to understand and evaluate the concern.

We reserve the right to remove or restrict content when appropriate.

25. Reviews and Customer-Submitted Content

The 5Ws Store may allow customers to submit:

  • reviews;

  • comments;

  • photographs;

  • questions;

  • testimonials; or

  • other content.

You may not submit content that:

  • you do not have the legal right to provide;

  • infringes another person’s intellectual property or privacy rights;

  • is knowingly false or misleading;

  • contains unlawful, threatening, abusive, or discriminatory material;

  • contains malicious or harmful technical content; or

  • otherwise violates applicable law.

You retain ownership of content you submit.

By voluntarily submitting content for publication through a store review or similar feature, you grant 5Ws, LLC a non-exclusive, worldwide, royalty-free license to host, reproduce, format, and display that content as reasonably necessary to operate the feature through which it was submitted.

Submission does not automatically grant 5Ws, LLC unrestricted permission to use that content in:

  • unrelated advertising;

  • paid advertising;

  • product packaging;

  • social-media advertising campaigns; or

  • other separate promotional campaigns.

We may separately request permission if we would like to use customer-submitted content for broader marketing purposes.

26. Photographs of Children

Submission of a customer photograph depicting an identifiable child does not constitute blanket authorization for 5Ws, LLC to use that child’s likeness in advertising or unrelated promotional materials.

If we wish to reuse customer-submitted content depicting an identifiable child outside the context in which it was originally submitted, we may request appropriate separate permission.

This provision does not apply to fictional, illustrated, rendered, digitally created, or AI-generated persons created or otherwise lawfully obtained by 5Ws, LLC for its own marketing materials.

27. Third-Party Services and Links

The 5Ws Store may use or interact with third-party services, including:

  • Shopify;

  • payment providers;

  • applications;

  • shipping carriers;

  • digital-delivery providers;

  • analytics providers;

  • social-media platforms; and

  • other service providers.

Third-party platforms and services may have their own terms, policies, and privacy practices.

We are not responsible merely because we provide a link to an unrelated third-party website for that website’s independent content, practices, availability, or security.

Nothing in this provision disclaims responsibilities that applicable law places on 5Ws, LLC for vendors or service providers we choose to use in fulfilling our own obligations.

28. Prohibited Website Conduct

You may not:

  • use The 5Ws Store for fraud or unlawful activity;

  • attempt unauthorized access to accounts, systems, or data;

  • introduce viruses, malware, malicious code, or harmful material;

  • interfere with website operation or security;

  • use automated systems in a manner that unreasonably burdens, exploits, disrupts, or circumvents the store;

  • scrape proprietary content for unauthorized commercial exploitation;

  • impersonate another person, business, or organization;

  • infringe intellectual property, privacy, or other legal rights;

  • submit fraudulent orders; or

  • submit fraudulent or unauthorized payment information.

Nothing in this section prohibits ordinary browsing, lawful linking, or legitimate search-engine indexing.

29. Suspension or Termination of Access

We may restrict or terminate access to The 5Ws Store when reasonably necessary to address:

  • fraud;

  • abuse;

  • unlawful activity;

  • security threats;

  • material violations of these Terms; or

  • similar legitimate concerns.

Termination of website access does not eliminate rights or obligations relating to previously completed transactions.

30. Warranties

We are responsible for providing products consistent with their descriptions and applicable law.

Unless a specific express written warranty is provided for a particular product, we do not guarantee that use of a product will produce a particular:

  • educational;

  • creative;

  • academic;

  • professional; or

  • subjective result.

We do not guarantee that the website itself will always operate without interruption, delay, technical error, or temporary unavailability.

Nothing in these Terms excludes, disclaims, limits, or modifies any warranty, product-safety protection, consumer protection, or other right that cannot lawfully be excluded, disclaimed, limited, or modified.

The existence of this warranty provision does not create a separate voluntary return right beyond the Return and Refund Policy.

31. Limitation of Liability

To the fullest extent permitted by applicable law, 5Ws, LLC will not be liable for indirect, incidental, special, exemplary, punitive, or consequential commercial damages arising solely from use of the website or products, including lost commercial profits, lost business opportunities, or lost data, where such damages may lawfully be limited.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

These Terms are not intended to improperly exclude or limit liability for:

  • personal injury;

  • product-safety obligations;

  • fraud;

  • willful misconduct; or

  • another matter for which liability cannot lawfully be excluded or limited.

Any limitation of liability will be interpreted only to the maximum extent enforceable under applicable law.

32. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless 5Ws, LLC from third-party claims, losses, or reasonable expenses resulting directly from:

  • your unlawful use of The 5Ws Store;

  • content you submitted without the legal right to provide it;

  • your infringement of another person’s intellectual property, privacy, or other legal rights through submitted content; or

  • a material violation of these Terms that causes a third-party claim against 5Ws, LLC.

This provision does not require a customer to indemnify 5Ws, LLC for our own unlawful conduct, defective products, or obligations that applicable law places on us.

33. Informal Resolution of Concerns

We encourage customers to contact us before initiating formal proceedings so that we have a reasonable opportunity to understand and attempt to resolve the concern.

Nothing in this section requires a customer to waive or surrender a non-waivable legal right or remedy.

34. Governing Law

Except where another law must apply, these Terms and transactions with 5Ws, LLC are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-laws principles.

Nothing in this choice-of-law provision deprives a consumer of a protection that applicable law does not permit the consumer to waive.

35. Venue

5Ws, LLC is located in Fairfax County, Virginia.

Subject to applicable law, any court proceeding arising from or relating to these Terms or a transaction with 5Ws, LLC shall be brought in an appropriate state court serving Fairfax County, Virginia, or the applicable federal court having jurisdiction over Fairfax County, Virginia.

This provision applies only to the extent the selected forum is lawful and enforceable under the circumstances.

These Terms do not require mandatory arbitration.

These Terms do not impose a contractual class-action waiver.

36. Time for Legal Claims

These Terms do not establish a special shortened contractual limitations period for bringing a legal claim.

Applicable statutes of limitation and other legally controlling filing periods govern.

37. Website Availability and Changes

We may prospectively modify, suspend, discontinue, or replace products, content, features, services, or portions of The 5Ws Store.

Website functionality may occasionally be unavailable because of:

  • maintenance;

  • security;

  • technical issues;

  • service-provider interruptions; or

  • operational circumstances.

Nothing in this provision eliminates our responsibility to appropriately address existing orders, payments, refunds, or other obligations.

38. Changes to These Terms

We may update these Terms from time to time to reflect changes to our:

  • business;

  • products;

  • website;

  • policies;

  • practices; or

  • applicable requirements.

The Last updated date at the top identifies the current revision.

Changes generally apply prospectively from the effective date of the revised Terms.

We will not use an updated version of these Terms to retroactively eliminate rights associated with a completed transaction where doing so would be unlawful.

39. Other Store Policies

These Terms should be read together with the other policies governing The 5Ws Store, including our:

  • Legal Notice;

  • Return and Refund Policy;

  • Purchase Options Cancellation Policy;

  • Privacy Policy; and

  • Shipping Policy.

Specific licenses, preorder terms, promotional conditions, bulk-order agreements, or product-specific terms disclosed before purchase may also apply.

Where a more specific provision expressly governs a particular product or transaction, that provision controls to the extent of a direct conflict with these general Terms, subject to applicable law.

40. Severability

If a provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the extent reasonably necessary to make it enforceable where permitted.

If it cannot appropriately be limited, the unenforceable portion will be severed without automatically invalidating the remaining provisions.

41. No Waiver

A failure by 5Ws, LLC to enforce a provision of these Terms on one occasion does not necessarily waive our right to enforce that provision or another provision later.

42. Entire Agreement

These Terms, together with applicable store policies and product-specific terms expressly incorporated into them, constitute the applicable agreement concerning use of The 5Ws Store and purchases made through it.

This section does not apply where 5Ws, LLC and a purchaser enter into a separate written agreement governing a particular transaction, such as an expressly negotiated bulk-order arrangement.
